美国司法审查权是指美国司法机构有能力对法律内容实施司法复核，并决定是否与现行的法规、条约或规矩相抵触，乃至于违反现行美国宪法和美国州宪法的条文规定。尽管美国宪法没有明确界定司法审查的权力，然而在参考宪法结构、相关规定以及历史发展等因素后，使得美国司法审查权成为一个实质权威[1]。
